Wall Street and the Rajaratnam case…About to hit FED TOWN!!!

Finally, the billionaire hedge fund manager Raj Rajaratnam is about to check into Federal Prison.. And, in an ironic twist for a man who made a living off market timing, the climate could not be worse for Wall Street criminals. Rajaratnam is the 54 old Sri Lankan born founder of the Galleon Group of Hedge Funds. He received an 11 year sentence. Part of this is based on his convictions, and part as a response to Rajaratnam’s apparent refusal to accept any responsibility for his actions.

So, let’s break this down and see how Raj has gotten to this desperate point and what he should have done and must start doing now.

The case of Rajaratnam is itself unique. He will be the only true billionaire who will most likely serve a ten-year plus term in Federal Prison. Think about it, most of the other Wall Street cases like Bernie Madoff, John Rigas, Richard Scrushy, Andy Fastow, Steve Madden and Martha Stewart have either received lighter sentences or do not still have big money by the time they hit the slammer. Blago will even be broke when he finally touches down at Fed Town. Raj was found guilty at trial of 14 counts of conspiracy and securities fraud including insider trading. Mistake number one! Raj could have worked out a plea agreement and faced a lesser prison term. Instead he went for broke as did his two former trading partners the Goffer brothers. In fact, Zvi Goffer received a ten-year sentence last week.

As we all know there are marches and protest all around the world right now. Occupy Wall Street has hit every major city in the United States and some overseas. There is little mercy for those who appear to have made illegal profits while many in the U.S. are struggling. Put this together with the way Raj and his team are acting and it spells FEDERAL PRISON. And I don’t mean a Federal Prison Camp. In fact, if Raj is sentenced to more that 10 years it is likely he will not be “camp” eligible for awhile and may have to start his prison term at an FCI or medium security prison like Madoff. Hey, they may even become bunkmates!

Our Criminal Justice System gives credit or “points” for accepting responsibility so start now Raj…

Many people do not know that a sentencing calculation is made up of a point system. Offense points, criminal history points and credits for accepting responsibility and pleading guilty. Yep, people also get credited points for cooperation in some cases. Raj did not plead guilty and so he has no credit points. To make matters worse for him, his lawyers have filed paperwork to try to mitigate his sentence saying Raj has a health condition but he still  is appearing very grandiose. Of course this did not sit well with the U.S. Attorney’s office and will not work with the judge either. In these after the fact proposals I always encourage the client and their legal team to show a reason for mercy and make a proposal that is relevant and meaningful. Translation: SHOW THE COURT YOU GET THE DRIFT AND ARE SORRY. But, many people do not want to admit  anything either because they will mount an appeal or because they do not feel they have done anything wrong. The bottom line is that you do not have to admit the crime but should admit that you have made poor choices and hence have earned a ticket to prison, and more importantly are willing to change your ways.

Changing your ways is key. Many of my clients think that because they have committed “white collar” crimes, they will be treated better in prison. WRONG!!!

How should Raj and his family prepare for prison?

The Rajaratnam family has a long road ahead. Not just Raj, but his entire family. His wife and three kids and all of his “friends.” I believe that an entire family actually needs to prepare for prison as it often more difficult on the family left behind than it is for the person inside. Raj and his family need to sit down and make a plan that includes how and when they will visit him and how they can get on with their lives and be productive while he is away.  But, they must get into the proper mindset to do this well. Once again, prison staff or other inmates do not treat “white collar” inmates better. I call prison the ultimate equalizer and this is why. Once inside there are different rules and codes of conduct. In fact, the staff will often look at “white collar” inmates harsher at first because they know that many have not been properly coached and still have an entitled attitude. Hint- Grandiosity and entitlement are what lands people in prison and does not help once you are there. Raj also will need to find a way to make his time productive and busy while letting his family know he is doing fine. NO pity parties and NO complaining. These are a few of the tips I would give to the Rajaratnams. I would also encourage them to learn all about the rules, regulations, food, jobs and more.

These are just a few ideas on how to prepare for prison. Last word is respect. Respect is key and that goes for respecting the other inmates, the staff and everybody’s personal space.  Believe it or not, prison is the easy part of this journey through our criminal justice process. So, Raj- Get real so you can get over it and get home! Otherwise, you will need an Incarcervention, something you should have had long ago!!!

What to expect when you are expecting…PRISON!!!

There are many types of people I work with as a prison consultant and legal coach. And, believe me it does take a village to handle all of these personalities. From Wall Street bigs, politicians and athletes to Celebrities, and even everyday mom and pop operators, mine is the best job on earth.

As fall begins we are about to embark on a season of very high profile and interesting cases. These include the trial of Dr. Conrad Murray, the sentencing’s of Blago, Raj Rajaratnam and Barry Bonds and the re trial of Roger Clemens just to name a few.

Yet, all of these cases and defendants need something different and all must cope with the reality that faces them; prison time. As with most of my clients and even myself, there are the everyday silly things to think about like prison food, living “accommodations” and fear of the other people inside. But, there are also families who will be left behind and children to care for and explain things to. You see, I not only work with the defendant but the entire family.

And there are the complexities of a person standing trial like Conrad Murray or Roger Clemens. In cases like that, I try to get the person facing trial to accept responsibility not for a crime but for the fact that certain choices have landed them in their current situation. It is with this acceptance that they can often find inner humility that will help carry them through a trial, sentencing and maybe even their prison term. It isn’t about what clothes they wear, and more about how they “present” themselves without ever saying a word.

For those actually getting ready to serve time, the concept is the same. Two things make prison easier: Respect and humility. Seems easy but we must remember that people going to prison often posses one or more criminal thinking errors such as grandiosity, entitlement, mollification and super optimism. Much to overcome.

But, I also work with the families, as families are the forgotten consequences of crime. To do this I must first get through all of the small issues like what you can bring, what job you should have, why YOU will not get the lower bunk at first and more. The most asked question is always about safety and then next is THE FOOD. And yes, COPS is popular in the TV rooms!

People must remember that prison is a great equalizer and no celebrity status can help you there. But, a good coach can. People passing through the criminal justice system, have patience and learn and follow the rules. Then, get ready to come home and live a better life. Look, if I did it, anybody can. As I always say, change is possible and prison is easy, re-entry is harder.

What’s Federal Prison Like on July 4- Freedom day???

Have you ever wondered what prison is like on Independence Day?  Ironic, as prison is a place you earn your way to by choosing to give up your freedom. Independence what? The truth is that in the Federal Prison system- the BOP- Bureau of Prison’s- puts it’s best self forward as they do on all holidays. This means card tournaments, sports events, movies and special meals. All with prizes. Yep, prizes. Why? Because prison is supposed to be for paying your debt to society and rehabilitation. The fact is that most people in prison in the U.S. are coming home and most in less than 5 years. So, a little perk here and there does serve a purpose and make inmates feel more like people. People they will one day need to be as they re-enter society.

Of course, I was in a Federal Prison Camp- a la Martha StewartSteve Madden and Mike Milken, but the BOP strives to make all Federal Prisons more tolerable on holidays. So, even Bernie Madoff will be living it up this Fourth of July weekend. Next year Blago will be as well.

The fact is that most inmates appreciate these “perks” and holidays are hard. The Fourth of July and the celebration of freedom is a tough concept to deal with in prison. That’s why most choose not to think and reflect about their choices and the consequences. Those who end up in prison in  the United States have made a choice in most cases. It’s that choice that is hard to accept and why some people keep making the wrong ones. For those I say get an Incarcervention. For others, remember we live in the land of the free and change is possible.

But, I urge all of us- even those who have FREEDOM, to sit back and show gratitude. We do live in the land of the FREE. Happy July 4!!

Wall Street Gone Wild- Otherwise known as insider trading!!!

ZVI GOFFER SENTENCED TO 10 YEARS…RAJ LOOK OUT

 

Another day, another round of guilty verdicts for Wall Street Bigs. Last month saw the conviction of Raj Rajaratnum, and today we have the conviction of three more heavyweights; Zvi Goffer, Emanuel Goffer and Michael Kimelman. They are all free on bail while awaiting sentencing. Ahhh Wall Street, the land of enablers!

Rajaratnam, the founder of the Galleon Group, was once Goffer’s boss. The Galleon investigation is the largest ever of insider trading in the hedge fund industry.

All of these men are now looking at lengthy prison sentences. The other thing they have in common is the fact that unlike most white-collar defendants, they did not strike a plea agreement. Instead, they opted to actually go to trial. Can you spell delusional? In fact, over 93% of all Federal criminal cases result in guilty pleas and of those, over 83% serve prison time. Not great odds, right?

It’s too bad that we cannot charge the guys for all of the money wasted on “investigating” this mess. Think about it, this money could be well spent to help all of the men and women in prison for years on small drug crimes when they really need rehab. I am not saying that the Wall Street bigs cannot learn from this, but so far all they have done is cost the taxpayers money on long trials and what are yet to be filed appeals.

Wall Street, good for business if you are a prison coach but now is the time for The Street to get real. This insider suggests that the major firms start to clean up their acts and learn from all of this. I say this with the best of insider knowledge and intentions. At some point we all have to take responsibility for our actions and turn our talents to good, not greed.

Believe me, change IS possible, but it takes hard work. Boys, call anytime you need some prison prep inside info. Don’t worry; I won’t mark my fee up like you did.

Rajer that!!!

Insider trader Raj Rajaratnam looks to be really going inside this time. Inside Federal prison that is. Raj was convicted on all 14 counts of securities fraud and conspiracy. This after failing to step up and accept a guilty plea that would have surely lessened the prison sentence that now is looming. Raj even spent over $40 million on his defense.

That is he spent $40 million while costing taxpayers several more millions for the investigation and trial. SO, at the end of the day what’s Raj to do and what does his family face? For me I look at how Raj can prepare for prison and that means helping his family prepare. But, how can you prepare somebody so grandiose and egocentric? Speaking from experience it can be done. Soon Raj will be living for probably at least 10 years in a large dormitory on the top bunk with guys from all walks of life. He will have to learn humility just to get along with these guys and the staff!

His family is another story. They now have the task of preparing to live without their husband and the father to three daughters. Sad that his greed has led him to this point and even sadder that he seems to not want to accept any responsibility. Maybe at sentencing we will see a sob story while he asks the Judge for mercy. Here is a prime example of Wall Street gone wild. Raj made plenty of money the legit way, he just pushed too far because he could. Or, at least he thought he could.

So, what’s next? I say once again more Wall Street fallout. Wall Street, be afraid, be very afraid but get ready. This insider knows there will be more soon. Change is possible but it takes hard work. Raj, if you are willing to do the work call me. I will set you straight and you will come home better and more focused than you are now while helping others for a change. Start NOW!
