It’s Not the trial of Michael Jackson…Been there, done that!

The much-anticipated trial of Dr. Conrad Murray is about to begin as jury selection is narrowed down. The trial, which is expected to last about 5 weeks, promises to be much more than just an ordinary doctor who may have prescribed too much medication. Prescription drug overdoses happen everyday and in many of the cases the prescriptions are NOT from multiple doctors, rather a doctor “feel good.”

In this case, there is little doubt that Michael Jackson was prescribed too many and too much medication. To make matters worse for Murray, his patient was Michael Jackson and many media outlets are billing this as “The Michael Jackson Trial.”

That being said, how is it possible for Conrad Murray to get a fair trial? The good news for Murray is that he has a very experienced and competent legal defense team. There is also a well versed and to the point judge named Michael Pastor.

But, with all of the speculation, the facts do show some ethical if not illegal decisions by Murray. SO, what else can he do and how can he revamp his image in case he is acquitted?

If Conrad Murray were my client I would have already started him on a path of redemption. For Dr. Murray as with anybody facing a trial and prison that is a process. In Murray’s case it is just a slightly different task as he is also dealing with the court of public opinion.

First things first:

Dr. Murray must show humility. This is often difficult for people, high profile or not, who are part of the criminal justice process. After all, there is denial and anger that always comes along with being a criminal defendant. But, humility is the most needed tool people in this situation need.

Next:

Dr. Murray must take responsibility for his choices. This in no way means he accepts or admits guilt. It simply means that he must acknowledge, if only to himself at first, that he made mistakes and the consequences have landed him in this situation.

Lastly:

Murray must learn to be quiet and let his lawyers do the talking. That includes any statements to the media and public outings. Sorry Murray but no more You Tube or Disneyland right now.

Tricks of my trade:

For any person in Murray’s shoes it is difficult to give up control and loose the grandiosity and ego that come with being a doctor. But, in order to humanize himself, both for the court and in case he does go to prison, Conrad Murray must follow this road. If clients can’t get to this point on their own I ask them to feel remorse for THEIR own  situation. That always works and if nothing else let’s the outside shine as the inside hopefully catches up. As with all of my clients, a little humility and a lot of vulnerability go a long way.

And if that’s not enough, remember that Prison is the ultimate equalizer!  As I always say: change is possible but it takes lots of work.

Lindsay Lohan- WHY do some people keep going back???

It appears that the worst kept secret in Los Angeles legal circles is true. Lindsay Lohan headed back to court .  As everyone who reads my blog knows, I have been a big supporter of Lohan and the alternative sentence she received in May. The sentence was a spilt of home confinement and substantial community service for two separate criminal legal issues. One, the violation of probation for her two D.U.I. arrests and the other for her NO CONTEST plea regarding the theft of a necklace. But, readers also know that as a legal coach I firmly believe that defendants who receive alternative sentences must take them seriously. Otherwise, judges will not hand them down and we are stuck with a criminal justice system that only incarcerates and does not rehabilitate.

Rehabilitation is a key necessity for our criminal justice system as over 95% of all people incarcerated in the United States will be coming home at some point.  So, what can insiders like me do? First, we must educate people to the flaws and strengths of our system and the reality of what works. For example, defendants in the Federal system have much stricter accountability than those in the State system. Accountability is the only known deterrent. Next, we must urge judges to practice equal justice. That said, I believe that Lohan has not been treated better than others. But, now we will see for sure.

And, to answer the question of why some people keep going back we only need to look at the fact that people who do not learn from their arrests and mistakes will only repeat them in more serious ways. As a legal coach I work with people to accept responsibility and stop blaming others. Hence, my term INCARCERVENTION. Often this makes me very unpopular with my clients. But, after a while they usually see the light and the fact that without owning your own actions you cannot move forward. Lohan clearly needed an incarcervention when she was having rooftop parties while under house arrest. But, it looks like none of the people who profess to care about her offered one.

Now, it seems the original judge in his haste to send Lohan to jail, did not order drug and alcohol testing after February 25, 2011. And, the new judge who handed the alternative sentence down did not realize this. So, despite the wishes of the probation department, Lohan will not go to jail and will not have to submit to any further testing. Here is hoping that Lohan keeps learning and changing. Lindsay, yes, change is possible. Keep working at it.

Tips from this insider for Lindsay Lohan and her FREEDOM!!!

The New Year is here and that means FREEDOM for Lindsay Lohan. The way she handles this freedom is up to her. Not many of us have had to live our legal and addiction problems under the same level of scrutiny as Lindsay. Every move has been watched and second-guessed by not only law enforcement, but also pop media. How ironic that Lindsay made so many top ten year in review lists, while Charlie Sheen made only a few.

So, some advice to Lindsay and those of us watching. Re-entry under any circumstance is a difficult process. Re-entry, while many are waiting for you to fail may seem like an entirely other thing all together. It really is not. After all, people look for those leaving prison to fail every day. Maybe not in the spotlight of the media, but failure and felony do seem to go together. They do not have to.

Lindsay needs to go about her re-entry as if she was just another person leaving custody or an alternative sentence. That means being ultra careful with all choices and decisions. It also means never forgetting where you just came from and how quickly you could go back or worse. Re-entry also means that you have to earn back the trust and respect of others. That, just like change, takes work and lots of it. The good news is that we live in the land of the free and America loves a good comeback.

Lindsay, take your time, practice some restorative justice and help others while helping yourself. This insider knows that the best chance for a successful re-entry is to be humble yet proud.

Lohan, the court system and WTF?????

Tonight comes word that Lindsay Lohan was released from UCLA- otherwise known as the psych ward. There must be an explanation as to where she was released to. We will know soon. What is clear is that this case is an example of what a MESS our system is. Lindsay was ordered to jail for 90 days- she served 13. She was ordered to 90 days of inpatient rehab; she was a patient for 23 days. But, as usual, the court orders had flaws. Lohan was ordered to undergo a psychological evaluation while in jail and then an appropriate place would be determined. It would seem that the evaluation showed that she needed to detox, become medically stable and then…

So, now no matter what, she will go through treatment. That could mean another facility or at least a structured outpatient program. The problem is that most courts do not get what type of treatment is needed. Remember, it was a DUI class that Lohan blew off that helped her fulfill her destiny of entitlement. What was the purpose of that?

The best this insider can offer is that there is much more to come. People will be screaming no matter what. I can hear the special treatment bus now. This is really about lack of treatment, not special treatment. There is nothing special about allowing taxpayers to foot the bill for this disaster and ultimately if Lohan has not learned anything she is likely to become another celebrity horror story. Here is hoping that somehow there is change afoot.

Lindsay Lohan- why should we expect it to sink in???

Two days after the Lohan sentencing, the media is all-abuzz about her behavior. Really?? Is it that shocking? Of course not. We do what we know, and she knows grandiosity, entitlement, delusion and USERS and TAKERS.

She also knows addiction and abuse. Hello, Michael! I do not feel sorry for Lohan for her jail time or rehab. What I do have empathy for is all that has led her here. The list of enablers is so long it would take up more time and space than we have. And, it seems to continue growing even today.

Lohan must hope that the court ordered evaluation is a serious one that will allow her to achieve some sobriety from her prescription drugs as well as mental health treatment. Jail will not do it. The California State prison system will most likely allow Lindsay to take some of her meds. This would not be the case on a longer term sentence or any Federal sentence.

We cannot expect a woman in denial to wake up because she is doing a short-term jail stint. There simply is not enough time. However, a woman like Lindsay does need to grow up and take responsibility. Especially when she claims to have missed DUI “classes” because of working. What work???

This insider asks all involved to stop the Lindsanity. This means the docs must stop throwing meds at her too. Our court system is going to be BUSY with the potential fallout from everyone involved.  The DUI program knows it’s coming. They were afraid of testifying. Wonder why? Could it be self-incrimination? They were the people who submitted court documents that Lohan was in compliance. That was a stretch of the truth.

The lawyer has fled the scene or been given the boot, and the docs are next. How many people need to OD before we understand prescription drugs?

There can be a positive end to this mess. I hope Lindsay gets the right team in place and learns about restorative justice. After all, there is more to the world than Lindsanity. Lindsay, change is possible and you need a QUALITY team to help you NOW.
